 The way it is now when you put your name on your signs it keeps people somewhat honest, there's nothing stopping people that just want to keep others out of an area to spray the trees purple just to keep you off the property. In the wrong hands this could be disastrous!

I have red paint( not going to change to purple) on my trees and signs with my name address etc.. on it and still get colorblind people who can't read English on my cameras that don't think that the law applies to them.  So if you see Red paint and my signs smile for one of the many cameras that you may walk past!  My phone # works if you need to talk with me about going past my line, I like to think that I'm a reasonable man to talk with.  The last people that i caught was within the last 2 weeks and they got a personal visit from me to talk about how it won't happen again.

 What I'm talking about has happened to a club I belonged to. The adjoining land owner put non identifying posted signs on about 40 acres that belonged to our club, trying to extend his land. When approached he denied having anything to do with it. Imagine having the purple rule in effect how much easier it would be for people to try and post land that don't belong to them with a stroke of paint.

 I post and maintain my land and my clubs every year, I know first hand what a pain this is but by having to put the land owners name on the signs keeps everybody honest!

Very true , delt with this stuff for years. Amazing how people are, some don't even know where their boundaries are. But alot just don't care.

Just a ? Are they all hunters trespassing or are they just people that think your land is there land I’ve had many people walking there dogs etc and the reply it get is these are my woods and I reply can I walk through your yard when I’m hunting!!! And always the answer is no

The people I had on camera 4 and 6 a couple of weeks ago were with their 3 dogs and not hunters. When I went and found them they were very curious as to how I knew exactly when they were there and had knowledge as to what kind of dogs AND what kind of clothes they had on. I like to think hunters have more respect for private property but unfortunately i have had encounters with a few over the years.  Texas has the right laws about trespass and penalties that come with it.  What's the deal here in NY--maybe a $50 fine and a slap on the hand?  I'm for increasing the penalties equal to Tx if you have them red handed with pictures with a timestamp and have signs with land owner information posted.  In Texas only the corners need to be marked with a public notice in the paper for 2 weeks every 5 years. You get caught there your headed to the crowbar hotel for an overnight!

Not saying it is untrue, but I have doubts someone went to jail in Texas because they walked their dog past a posted sign in the woods.  Increased cash penalties would possibly help.  Even better, you as the landowner with that degree of evidence can file and prosecute that offense yourself.  It's a win win because the time you invest in making sure people don't cross your private property results in the offenders paying a fine and detering the behavior.  Then word makes it around town and deters further behavior.

But in reality you can literally walk across an international border and get flown to the city of your choice, for free, by the government.  So I wouldn't hold out on stricter simple trespass offenses.

Dude, I'm not saying you're lying and I think you know that. I'm saying that no one has gone to jail for walking their dog past a posted sign.  I mean you'd have to be a several times over repeat offender to earn that one. And while I appreciate the reference to a defense attorney's website for the definitive proof on the law, just know that the law in NY also states you can go to jail for trespass, up to 15 days to be specific for the lowest level offense.

And I think you're reference spending the night has to do with posting bail, not being punished. Totally different

Walking your dogs past my posted sign when it's deer or any other season with the possibility of disturbing me or my guests hunt or game on my side of the line is a crime as far as my thinking goes.  I called one of my best friends, my roommate at Texas A&M and godfather to my 2 children and caught him getting into his deer box blind on his cell in the East Texas Pine woods this evening and asked him how serious trespass was by him, he laughed and said Carm was right because the trespasser would be very fortunate to even make it to a judge on some of the ranches he knows.  I will give you his direct words, "pretty much your A$$ is at risk if you trespass in Texas."  i know where you're coming from Carm and don't want to make a fight over interpretation of our thoughts but I think people trespass more often in NY because the laws are written by bleeding hearts that don't understand private property rights and have made the consequences weak and worth the risk.
